By accessing or using the Platform in any manner, including, but not limited to, visiting or browsing the Platform or contributing content or other materials to the Platform, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.
1. Scope of Services & Role Clarification
- Service Definition: We operate an online Platform dedicated to providing information and generating leads related to RERA (Real Estate Regulatory Authority) compliant new launch, under-construction and ready-to-move-in real estate projects in India. Our services include publishing property-related information, insights, updates, and facilitating the connection between potential buyers ("Users") and the respective property developers or their authorized Brokers/Representatives for lead generation purposes.
- Exclusion of Services: The Platform strictly excludes listings for resale or rental properties. Furthermore, we do not provide or facilitate site visit assistance, brokerage services, transaction negotiation, payment handling, or any direct involvement in the sale or purchase agreement between the User and the Developer/Broker/Seller.
- Role Clarification: Our role is strictly limited to that of an intermediary information provider and lead generation platform. We connect interested Users with Developers and/or their authorized Brokers based on the information listed. We do not act as, nor represent ourselves as, the Developer, Seller, or Broker of any listed properties. We are not a party to any transaction that may occur between Users and Developers/Brokers/Sellers.
2. RERA Compliance
- RERA Registration Information: We endeavor to list only those projects which are represented to us by Developers/Brokers as being registered under the Real Estate (Regulation and Development) Act, 2016 ("RERA Act"). We strive to display the RERA registration details as provided by the Developers/Brokers for each project listed.
- Disclaimer on Information: The property information, including RERA details, project specifications, amenities, pricing, and availability, is sourced directly from Developers or their authorized Representatives. While We make reasonable efforts to ensure the information is current, it is subject to change without notice based on updates from the source. We do not independently verify all such information.
- User Verification Recommended: Users are strongly advised to independently verify all project details, including RERA registration status, approvals, and legal documentation, directly with the Developer/Broker and through the official RERA website of the respective state before making any decisions or commitments. 3. Accuracy of Information & User Due Diligence
- Information Disclaimer: While We strive for accuracy, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the Platform or the information, products, services, or related graphics contained on the Platform for any purpose. Any reliance you place on such information is therefore strictly at your own risk.
- User Due Diligence: Users acknowledge and agree that they are solely responsible for conducting their own due diligence, investigation, and verification of any property listed on the Platform before entering into any agreement or transaction. This includes verifying legal titles, approvals, project timelines, developer credentials, and all other relevant factors.
4. Limitation of Liability
- Disclaimer of Responsibility: To the fullest extent permitted by law, PROPLAUNCH360 PRIVATE LIMITED, its affiliates, officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from
(i) your access to or use of or inability to access or use the Platform;
(ii) any conduct or content of any third party on the Platform, including without limitation, any defamatory, offensive, or illegal conduct of other users or third parties;
(iii) any content obtained from the Platform; or
(iv) unauthorized access, use, or alteration of your transmissions or content.
- No Guarantee of Project Completion: Information regarding under-construction projects, including estimated completion dates, is provided based on information received from Developers/Brokers. We do not guarantee, warrant, or take responsibility for the timelines, quality of construction, or successful completion and delivery of any project listed on the Platform. Users must address any concerns regarding project status or completion directly with the Developer.
5. User Obligations and Conduct
- Accurate Information: Users agree to provide true, accurate, current, and complete information when submitting inquiry forms or otherwise interacting with the Platform. We are not responsible for any issues, communication failures, or disputes arising from false, inaccurate, or incomplete information provided by Users.
- Prohibited Actions: Users are strictly prohibited from:
- Engaging in data scraping, mining, or harvesting of any content from the Platform.
- Submitting false, misleading, or fraudulent inquiries or information.
- Using the Platform for any illegal or unauthorized purpose.
- Interfering with the security or proper functioning of the Platform.
- Attempting to gain unauthorized access to any systems or networks connected to the Platform.
- Misrepresenting their identity or affiliation.
- Compliance with Laws: Users agree to use the Platform in compliance with all applicable local, state, national, and international laws and regulations.

- Opt-Out: You may opt out of receiving marketing communications at any time by following the unsubscribe instructions provided in such communications or by contacting us directly.
7. Intellectual Property Rights
- Ownership of Content: All content present on this Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, digital downloads, data compilations, and software, is the property of PROPLAUNCH360 PRIVATE LIMITED or its content suppliers and is protected by Indian and international copyright laws.
- Limited License: We grant you a limited, non-exclusive, non-transferable license to access and make personal use of the Platform. This license does not include any resale or commercial use of the Platform or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this Platform or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.
- Third-Party Content: Certain content, such as project images or developer logos, may be the intellectual property of third parties (e.g., developers) and is used on the Platform with permission or as permitted by law. Such content remains the property of its respective owners.
8. Data Privacy and Compliance
- Compliance with Laws: We are committed to protecting your privacy. We collect, use, store, and process your personal information in accordance with our Privacy Policy https://proplaunch360.com/privacy-policy and in compliance with applicable Indian laws, including the Information Technology Act, 2000, and its rules, and the Digital Personal Data Protection Act, 2023 (DPDP Act).

9. Non-Brokerage Disclaimer
- Clarification of Role: It is explicitly stated and understood that PROPLAUNCH360 PRIVATE LIMITED operates solely as an online information portal and lead generation platform connecting Users with developers/brokers for new launch, under-construction and ready to move in projects. We do not provide real estate brokerage services, advisory services, or participate in any negotiations or financial transactions related to property sales. We are not registered as, nor do we function as, a real estate agent or broker under the RERA Act in respect of facilitating transactions.
10. Indemnification
- User Agreement to Indemnify: You agree to indemnify, defend, and hold harmless PROPLAUNCH360 PRIVATE LIMITED its affiliates, officers, directors, employees, agents, and suppliers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to (i) your use of the Platform; (ii) your violation of these Terms; (iii) your violation of any rights of a third party, including developers, brokers, or other users; or (iv) any content you submit or transmit through the Platform.
11. Termination of Access
- Right to Terminate: We reserve the right, in our sole discretion, to terminate or suspend your access to all or part of the Platform, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms and Conditions. Upon termination, your right to use the Platform will immediately cease.
12. Third-Party Links
- External Links: The Platform may contain links to third-party websites or services that are not owned or controlled by PROPLAUNCH360 PRIVATE LIMITED. We provide these links solely for user convenience and information.
